Talk about rubbing it in: A Morgan Stanley wealth manager who struck a cyclist in Colorado dodged jail this week after blaming "new car smell" in his 2010 Mercedes.
Martin Erzinger, 52, struck Dr. Steven Milo and then fled the scene -- hiding his car behind an abandoned Pizza Hut, according to Milo's attorney.
But Erzinger's lawyers say he suffers from sleep apnea, and the smell of his brand-new luxury car could have altered his consciousness and caused the accident.
"It would be felonious behavior for any of us to leave after accident, but not someone who suffers from sleep apnea," a medical defense expert testified according to TheDenverChannel.com.
Erzinger will have to take a leave of absence from his job to complete 45 days of community service. He'll also lose his license for a year and be required to make charitable donations, instead of paying court fines.
Milo is still recovering from spinal damage, brain bleeding and injuries to his knee and shoulder, his attorney said, and is disappointed by the ruling.
